Carlton Fields' Attorney Quoted in Article About E-Discovery and Social Media in Workplace Investigations

Tampa, Fla. – Carlton Fields Tampa associate, Rebecca Shwayri, was quoted in a news article, “E-Discovery and Social Media in Workplace Investigations,” published August 4, 2011 by the iSight.com Blog: News & Tools for Better Investigations. The article discusses how social media could provide necessary evidence in a lawsuit.

Shwayri says, “Lawyers are starting to realize that information contained on social media sites may be related to litigation and are having to navigate the intersection of technology and the law. Because many social networking sites are owned and controlled by third parties, the preservation issues can be more difficult to manage.” Due to the growth in social media sites and users, she adds that preservation should be part of a company’s social media policy because it will “continue to be relevant in cases involving emotional distress damages and employment cases as well as cases in which social media postings are related to the issues in the litigation.”

Shwayri is a member of Carlton Fields’ E-Discovery Task Force and has assisted the firm and its clients in developing policies for the institution of litigation holds and the preservation of electronically stored information. Additionally, she is a member of the firm’s Business Litigation and Trade Regulation practice group and represents corporations, financial institutions, and business clients in disputes involving breach of contract, breach of fiduciary duty, class action, and conversion claims.
