- electronic discovery -- counseling clients in developing organizational policies, procedures, and systems to effectively and efficiently participate in discovery involving Electronically Stored Information (“ESI”), as well as representing clients on ESI discovery matters in litigation.
He has also tried lengthy commercial arbitrations and some of the more complex proceedings brought in a Florida administrative forum. Pass has counseled clients in matters of dispute avoidance, pre-litigation planning and strategic decision making in circumstances implicating potential litigation risk. Pass heads the Carlton Fields’ Electronic Discovery Group, is a member of The Sedona Conference Working Group On Electronic Document Retention and Production, and has spoken and published in the area of Electronic Discovery. He received his J.D., with high honors, from the Florida State University in 1974 and his B.A. in Government and Economics from the Florida State University in 1971.
Shwayri represents corporations, financial institutions, and business clients in disputes involving breach of contract, breach of fiduciary duty, class action, and conversion claims. She has experience representing mortgage holders in commercial foreclosure proceedings. She also represents individuals and organizations in probate litigation. Shwayri represents companies and individuals in different forums, including state and federal court, arbitrations, and mediation proceedings. She served as a judicial law clerk to the Honorable Patricia C. Fawsett, Chief United States District Court Judge for the Middle District of Florida. Shwayri is a member of the Carlton Fields' Electronic-Discovery Task Force and is a regular contributor to the firm’s Class Action Blog. She received her J.D., magna cum laude, from the University of Florida College of Law in 2004 and received her B.A., summa cum laude, from George Washington University in 2001.
