Scott Pence and Mark Smith Discuss the Importance of Understanding the Potential Risks and Liabilities Involved in Construction Contracts

Tampa, Fla. – Carlton Fields Tampa Shareholder Mark Smith and Associate Scott Pence recently presented a seminar entitled, “Key Construction Contract Provisions: Understand the Potential Risks and Liabilities Involved in Construction Contracts,” which targeted attorneys, owners, developers, contractors, construction managers, project managers, consultants, architects, engineers, presidents, vice presidents, controllers and other construction professionals. The presentation was held by WPL Publishing Co., Inc., a company that provides news and insights on the construction industry surrounding legal issues, green building, project controls and building information management, scheduling and contract management.

Smith and Pence’s presentation discussed how participants can minimize liability as negotiating construction contracts can be tricky and risky. Both Smith and Pence urged participants to learn about key construction provisions so those risks can be properly allocated. They said that key provisions include: indemnification, insurance, liquidated damages, waiver of consequential damages, delay (i.e. no-damage-for-delay, force majeure, etc.), warranty/correction obligations, differing site conditions, and termination.
