Three Carlton Fields Attorneys Author Article for IPFrontline

Tampa – Edward PageCatherine Salinas Acree, and Rebecca Shwayri authored an article, “Applying Predictive Coding to DOJ Data Dumps,” on IPFrontline on March 25, 2012. The article discusses the use of computer-assisted review to more accurately and quickly locate electronically stored information. Specifically, the article discusses a recent case, Moore v. Publicis Groupe & MSL Groupe, in which the judge approved the use of predictive coding – the first case to date endorsing the use of predictive coding technology. As Page, Salinas Acree and Shwayri explain that the Moore opinion “deals with the parties’ disputes about the development of an agreed-upon protocol to govern the production of ESI. In the white collar context, there may be no negotiation about protocol – the prosecutors simply determine whether production is required …”
