Carlton Fields Class Action Survey Highlighted in Florida Trend: “Critical Mass”

Carlton Fields was featured in Florida Trend, in an article titled “Critical Mass.'” The article discusses the trends, issues, and major players influencing the landscape of class actions and mass tort claims in Florida.

The piece quotes Carlton Fields’ 2024 Class Action Survey throughout, highlighting factors such as nationwide spending on defending class action suits, types of matters that see the most litigation, how many of these suits come to an end, and more.

Matt Allen was interviewed for the piece and stated that most class actions end with a settlement. Even when the company feels the claim is baseless, settling is the cheaper route. “If there’s risk, and there is for the defendant, you can get an individual settlement for nuisance value at the front end of the case before you invest thousands, if not a million dollars into defending the case. You have to do it as a rational economic actor,” said Allen.
