David Walz Quoted in Law360: “Product Liability Regulation and Legislation to Watch in 2024”

David Walz was quoted in Law360, in an article titled “Product Liability Regulation and Legislation to Watch In 2024.” The article discusses the regulatory and legislative issues that product liability attorneys will be watching regarding increased enforcement activity by federal regulators over unsafe consumer products, and how changes to civil procedure rules will shape how mass torts are run.

Walz comments on an amendment to Rule 702 of the Federal Rules of Evidence, which took effect on December 1, 2023.

"The amendments are really an effort to get back to the real gatekeeper standard, the classic Rule 702 gatekeeper kind of analysis where the trial court is there to protect jurors from unestablished and unreliable science," Walz said. "That'll be interesting to see in the sense of the courts — how that affects some of the expert opinions that are all on less established grounds scientifically."
