Practice Experience
- Ms. Granade has a nationally recognized reputation in the fields of privacy and security law. She has helped clients implement policies and procedures that comply with the requirements of state and federal privacy and security laws, as well as various industry standards.
- Ms. Granade assists clients that have experienced a data breach due to a theft (e.g., stolen laptops and servers) or an accident (e.g., natural disasters, lost backup tapes). Assistance includes but is not limited to advising clients regarding applicable data breach notification laws, drafting notification to individuals impacted by a data breach and helping clients notify state Attorneys General and consumer protection agencies when required to do so by law. Clients also receive risk assessment and management advice in an effort to reduce the likelihood of future data breaches
- Ms. Granade’s clients frequently ask her to analyze privacy and security complaints (internal as well as external, including resulting government investigations). As part of this process, she conducts employee interviews, reviews audit trails, investigates the events surrounding an alleged violation, reviews and if necessary recommends revisions of company policies and procedures, and responds to federal and state authorities concerning privacy and security concerns. Ms. Granade’s clients include various large organizations, including the largest hospital chain in the nation and an international organization of athletes.
- Ms. Granade represents hospitals and other entities subject to the privacy and security regulations promulgated pursuant to the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). She often assists these organizations defend themselves during privacy and security investigations brought by the U.S. Department of Health and Human Services’ Office for Civil Rights (OCR) and the Centers for Medicare and Medicaid Services (CMS), respectively.
- In addition to her extensive experience with privacy and security laws, Ms. Granade assists hospitals, medical schools, health insurance companies, Internet health care companies, and equipment manufacturers and distributors with issues related to research and clinical trials, liability and risk management, Food and Drug Administration regulations, and third-party payor reimbursement. Ms. Granade also has assisted the investment banking industry on numerous occasions with health care company acquisitions.
