We are courtroom lawyers.

The attorneys in Carlton Fields’ Products and Toxic Tort Liability practice group have significant trial and appellate experience in state and federal courts and have tried cases on behalf of numerous drug and medical device clients. Our trial lawyers possess a wide variety of backgrounds and have extensive experience defending and managing product liability cases, especially class action and mass tort litigation.

We advance our clients’ interests in court and elsewhere.

Many of our attorneys are former judicial clerks and possess in-depth knowledge of the judicial systems and judges’ preferences. Our lawyers regularly argue motions and try cases before these judges, and have earned a reputation for excellence.

Carlton Fields has a preeminent, nationally recognized Appellate and Trial Support practice group that advises and supports our trial practice. Our appellate lawyers frequently participate in developing pre-trial strategy, motion practice, and trial preparation; advise on evidentiary issues; write and argue motions before, during and after trial; and handle appeals. By involving our appellate lawyers in cases early on, especially in regards to key outcome-determinative legal issues, we are able to achieve greater efficiencies and better results.

Our Government Consulting practice group represents numerous clients before the Florida legislature and various state executive and regulatory agencies. Carlton Fields attorneys have significant experience in Florida’s tort reform efforts, including active participation in TRUE (Tort Reform United Effort), a lobbying and public affairs coalition of businesses and associations brought together and funded with the goal of substantially amending Florida tort law.

We have the resources to manage complex litigation.

Carlton Fields’ e-Discovery Task Force closely monitors developments in e-discovery issues, including the recent changes to the Federal Rules. This task force works with clients prior to and at the onset of litigation to increase the effectiveness and efficiency of client discovery efforts, ensure compliance with applicable laws and rules, and reduce client exposure.

Our Class Action Task Force is comprised of lawyers with extensive experience addressing the challenges of class action litigation. We regularly call on our Class Action Task Force to advise on class action litigation avoidance and steps to take when dealing with class actions.

Finally, Carlton Fields uses document management software that enables us to organize, digitize, and make available to clients and co-counsel discovery materials, client materials, attorney work product, and litigation status reports in a secure extranet environment.
