Carlton Fields' Pharmaceutical and Medical Device Team specializes in defending drug and medical device manufacturers in individual, mass tort, class action, and other complex litigation matters from inception through appeal. The Pharmaceutical and Medical Device Team attorneys are also skilled legal drafters and orators, and have enjoyed numerous successes defeating claims via dispositive motions and during other pre-trial stages. Additionally, our attorneys are widely recognized for their knowledge of pharmaceutical and medical device law and related issues, and frequently lecture and publish articles and newsletters and participate in numerous professional organizations.

The attorneys in Carlton Fields’ Products and Toxic Tort Liability Practice Group, in which our Pharmaceutical and Medical Device Team are members, have significant trial and appellate experience in state and federal courts and have tried cases on behalf of numerous drug and medical device clients. Our trial lawyers have extensive experience defending and managing product liability cases, including class action and mass tort litigation.
Carlton Fields has a preeminent, nationally recognized Appellate and Trial Support Practice Group that advises and supports Carlton Fields' litigators, including the Pharmaceutical and Medical Device Team. Our appellate lawyers frequently participate in developing pre-trial strategy, motion practice, and trial preparation; advise on evidentiary issues; write and argue motions before, during, and after trial; and handle appeals. By involving our appellate lawyers in cases early on, especially in regards to key outcome-determinative legal issues, we are able to achieve greater efficiencies and better results.

When our clients face complex and challenging litigation, the Pharmaceutical and Medical Device Team calls upon the firm’s litigation support teams, including our Expert Team, to assist in providing efficient and effective representation for our clients. The Expert Team closely monitors and analyzes decisions on expert witness issues, and disseminates pertinent and timely information across the firm. Because of this, our Pharmaceutical and Medical Device Team is well prepared to deal with expert witnesses issues, including admissibility and challenges to expert testimony under federal and state law.
Carlton Fields’ E-Discovery Team closely monitors developments in e-discovery issues, including the recent changes to the Federal Rules. This Team works with clients and the Pharmaceutical and Medical Device Team prior to and at the onset of litigation to increase the effectiveness and efficiency of client discovery efforts, ensure compliance with applicable laws and rules, and reduce client exposure.
Our Class Action Team is comprised of lawyers with extensive experience addressing the challenges of class action litigation. The Pharmaceutical and Medical Device Team regularly calls on the Class Action Team to advise on class action litigation avoidance and steps to take when dealing with class actions.

Carlton Fields uses document management software that enables the Pharmaceutical and Medical Device Team to organize, digitize, and make available to clients and co-counsel discovery materials, client materials, attorney work product, and litigation status reports in a secure extranet environment.
