Key Matters 

• Represented title insurance underwriters, achieving multiple dismissals of putative class actions and denials of class certification in multi-state and statewide class actions across the country 
• Represented nationwide retail chain in extensive lease litigation involving unique contractual provisions concerning common area maintenance expenses, and obtained significant cost savings for tenant over the lease term for several retail locations
• Represented title insurer, securing multi-million dollar recovery of escrow funds missing due to title agent’s mishandling of hundreds of condominium conversion sales
• Represented national and regional commercial property owners in complex state and federal litigation involving lease enforcement and tenant disputes, bankruptcy, class actions, development consent litigation, zoning/code issues, intellectual property interests, government interaction, and First Amendment/public curfew issues
• Represented title insurer, recovering approximately $6 million from liability insurer for title agent’s defalcation and misappropriation of escrow funds
