Schwartz Talks About False Claims Enforcement Against EHR Developers

Carlton Fields White Collar Crime and Government Investigations Practice Group Chair, Adam Schwartz, was featured on the American Health Law Association’s Speaking of Health Law podcast. The program addressed the rise of false claims enforcement against electronic health record (EHR) developers.

There has been an inflation of investigations into EHR developers for false claims violations, brought about by whistleblowers or the federal government themselves.

Schwartz suggests developers under investigation conduct their own thorough internal investigation as quickly as possible, and consult with compliance specialists that are able to assist with the often complex regulatory requirements.

He also advises that future investigations of this type could include the possibility of the federal government pushing criminal penalties, and the potential for individuals, instead of only companies, being included in the prosecution.
