Carlton Fields insurance attorneys Ann Black and Jamie Bigayer were quoted in a Law360 article, “Insurers Grapple With Proxy Bias Problem in AI Use,” about the potential unintentional discrimination that can occur within insurance technology and how the insurance industry and several states are attempting to handle the issue.

“Colorado went furthest, passing a law in 2021 that requires insurers to test their data sources and algorithms for racial bias. Under the law, insurers must understand their own use of consumer data and how that data is being used by any third-party algorithms the insurer utilizes,” advised Black and Bigayer.
