Carlton Fields attorney Alan Rosenthal was quoted in an article for the Daily Business Review titled, “Victory for Carlton Fields: Firm Helps Client Triumph in Nearly Decadelong Litigation.” The piece discusses a recent Florida appeals court decision affirming a win for Carlton Fields and its client, the City of Miami Beach. In a long-running dispute with a nightclub owner who said the city put him out of business following a code-inspection bribery scandal, Florida’s Third District Court of Appeal agreed with a lower court that the club owner failed to connect code enforcement actions to its closure.
Rosenthal stated, "It is uncommon for a state appellate court to opine on federal constitutional due process. When they do, it informs citizens, lawyers, and judges about how citizens’ and governments’ rights must be balanced. Such clarity enables courts to fairly decide due process claims made by the citizenry.”
