Steven Weisburd Interviewed in National Law Journal: “Is a Surge of Mass Arbitration Really Coming?”

Steven Weisburd was interviewed in a National Law Journal article titled “Is a Surge of Mass Arbitration Really Coming?” The article discusses warnings from defense lawyers on increased mass arbitrations and cites the 2023 Carlton Fields Class Action Survey, in which 3.9% of surveyed companies reported having faced mass arbitration.

Weisburd called mass arbitration the “wild west of uncertainty,” citing unanticipated procedural expenses and arbitrators’ fees. “But the threat of that increasing is a real one, if not a likelihood,” he said. “I wouldn’t be surprised to see an increase in mass arbitration.”
