Carlton Fields Associate Justin S. Wales was quoted in the Daily Business Review article, “Development Decisions Trigger Miami Initiative on Right to Sue.” The article discusses how Wales proposed an upcoming ballot initiative, which if passed in November, would give Miami-Dade County residents the right to sue the City of Miami should it violate its own city charter. City commissioners approved the ballot question last month.
The ballot initiative stems from previous legal fights between residents and the City of Miami, whose attorneys have repeatedly argued issues of standing against residents claiming charter violations. “We've seen a number of instances where the city has acted in a way that some citizens alleged was in violation of the charter," said Wales, who is also a member of Miami's Charter Review and Reform Committee.
