Elizabeth Bohn co-chairs the firm’s Consumer Finance Industry Group.

While she has represented banks and other lenders in state, federal and bankruptcy court litigation and arbitration proceedings involving a variety of matters for over 25 years, her current practice focus is defending financial service industry clients in individual and class action claims for violations of federal consumer financial protection legislation, including the Fair Debt Collection Practices Act (FDCPA), Real Estate Settlement Procedures Act (RESPA), Fair Credit Reporting Act (FCRA), Fair Credit Billing Act (FCBA), Telephone Consumer Protection Act (TCPA), Truth In Lending Act (TILA), FTC Act, and Florida state consumer protection laws.

Ms. Bohn also counsels consumer financial service industry clients and speaks frequently on compliance with federal consumer financial protection laws, including the TCPA, RESPA, FDCPA, Dodd-Frank’s Consumer Financial Protection Act, the FTC Act, and CFPB guidance and regulations applicable to mortgages, credit cards, auto loans and other consumer financial products, as well as Florida state statutes regulating consumer, real estate, and auto finance.

She has also represented a variety of commercial lenders and other businesses in complex commercial foreclosures, bankruptcy and loan workouts, and other litigation involving security interests, fraud, interference, breach of fiduciary duty, conversion, accounting, software, and other business-related claims.

Ms. Bohn currently serves as ACA International’s Florida state compliance chair. She previously chaired the ABA Banking Law Committee's Loan Workouts and Bankruptcy Subcommittee (2005 – 2009), and the ABA Commercial Finance Committee's Creditors' Rights Subcommittee (2011 - 2014).

Her recent matters have included counseling on CFPB mortgage servicing and UDAAP regulations; favorable settlements of individual and class action claims alleging violations of RESPA, TCPA, FCCPA, and FDCPA; an 11th Circuit decision upholding district court's denial of a motion to compel arbitration under an Internet click-wrap agreement; the dismissal of claims by a hotel franchise against a hotel chain's software designer; an emergency injunction obtained in district court enjoining seller of GPS products from enforcing an ex post-facto Internet click-wrap agreement against a retail auto lender who purchased the products; representation of an auto floor plan lender in the dealer's Chapter 11 bankruptcy and state court litigation after stay relief resulting in recovery of all collateral and collection of entire debt.
