This alert is intended as an update on an Act signed January 29, 2009 by President Obama that makes it easier for employees to sue employers for pay discrimination. The Act loosens statute of limitations requirements so that an employee may sue now for a pay decision that may have been made many years ago.

This alert summarizes the recent decision in Rosenberg v. Gould, in which the United States Court of Appeals for the Eleventh Circuit held that a securities fraud complaint based on stock option backdating allegations failed to satisfy the heightened requirements for pleading scienter – i.e., fraudulent intent - contained in the Private Securities Litigation Reform Act of 1995.

The alert is intended to update you on amendments to the Family and Medical Leave Act as a result of two provisions of the National Defense Authorization Act, which go into effect on January 16, 2009. The Family and Medical Leave Act now includes two new military family leave entitlements for eligible specified family members, and new or revised regulations with accompanying forms and notices for employees.
