Overview

Frank Appicelli concentrates his practice in the areas of commercial finance and real estate, and regularly represents commercial lenders, developers, investors, and owners of real estate.

Frank advises insurance companies, commercial banks and other debt providers in mortgage loan transactions involving acquisition and permanent financings, construction loans, credit tenant loans, and revolving credit facilities. He also represents developers, investors and owners in real estate acquisitions and dispositions, project development, and commercial leasing matters. 

The properties involved in Frank's transactions include shopping centers and other retail facilities, multi-family housing complexes, office buildings, industrial and warehouse facilities, hospitals and medical facilities, assisted living and other senior housing projects, and hotels and lodging properties.

Frank also represents commercial lenders in commercial credit and asset-based loan transactions involving revolving credit and term loan facilities, letter of credit facilities, and liquidity and other credit enhancement facilities.

Frank also counsels clients in distressed real estate transactions and is actively involved in workouts, restructurings, deeds-in-lieu of foreclosure and discounted payoff arrangements, foreclosures and bankruptcies.  He is involved with properties throughout the United States in single-asset real property and multi-asset portfolios.

He also advises clients in the purchase and sale of loans and other debt instruments. These transactions have involved par/near par loans and distressed debt involving syndicated credit facilities and whole loans, and have been conducted as single loan transactions, multiple loan transactions, and portfolio and bulk sale transactions.

Frank has been identified as one of the best real estate lawyers in Band 1 of Chambers USA, a compilation of America’s leading business lawyers, and in 2010 he was recognized as the Hartford Real Estate Lawyer of the Year by Best Lawyers. He has also been included in Lawdragon 3000 Leading Lawyers in America. He serves as an officer and member of the Board of Directors of the Real Estate Finance Association of Connecticut (REFA). He chairs the firm's real estate and commercial finance  practice group.

Experience

  • Represented The Hartford in $195 million mortgage loan to national real estate owner for acquisition of 31 shopping centers in eight states.
  • Represented The Hartford in $250 million mortgage loan to national real estate investor for acquisition and refinancing of 26 warehouse facilities in eight states.
  • Represented TD Bank as agent in $155 million syndicated mortgage loan to national real estate investor for 700 acre Merrill Lynch campus in New Jersey.
  • Represented People’s United Bank in acquisition mortgage loan to German pension fund for historic mixed-use complex in Philadelphia.
  • Represented The Hartford in $100 million mortgage loan to national pension fund secured by trophy-office property in Houston.
  • Represented Wells Fargo as special servicer in bankruptcy, foreclosures, and property administration and dispositions involving $400 million commercial mortgage backed securities secured by office, warehouse, distribution and manufacturing facilities leased to regional retailer which subsequently filed for Chapter 11 bankruptcy  protection.
  • Represented Royal Bank of Scotland in foreclosure, receivership and disposition of seven building office portfolio in Connecticut.
  • Represented hotel owner and operator in development, acquisition and financing of hotel properties in New York, Connecticut, Rhode Island, Pennsylvania, Florida, Oklahoma, and Wisconsin.
  • Represented senior housing developer and operator in development, acquisition, joint venture and financing of assisted living and memory-care facilities in Massachusetts, Maine, and New Hampshire.
