Overview

Justan Bounds is a shareholder in the business litigation group. He represents public and private companies, their officers, directors, and employees, and individual clients in a wide range of complex commercial disputes, including representing entertainers and Fortune 500 media clients in all manners of dispute resolution from constitutional to contractual to employment disputes, representing companies, officers, and directors in federal securities actions (both SEC enforcement and class actions), representing software companies in trademark, copyright, and licensing disputes, and representing creditors in sophisticated post-judgment collection actions to pierce the corporate veil and avoid fraudulent conveyances.

Prior to practicing law, Justan taught history and government and coached baseball in Fulton County.

Experience

  • Defended Atlanta-based entertainer in defamation and tortious interference claim alleging $20 million in damages related to production of television show.
  • Defended independent directors of an investment company in securities class action that alleged more than $140 million in damages related to the company’s public disclosures.
  • Presented multimillion-dollar breach of contract claim against business software customer. Matter settled while motion for summary judgment was pending.
  • Litigated breach of contract claims of management company client against facility owner. Handled each stage of litigation, from arbitration to eventual appeal in the Supreme Court of Georgia.
  • Defended client against a $500,000 claim for alleged violations of the Georgia Fair Business Practices Act and the federal Fair Debt Collection Practices Act. Secured dismissal with prejudice in client’s favor.
  • Pursued various post-judgment strategies (including post-judgment discovery, garnishment proceedings, and an action to pierce the corporate veil and set aside fraudulent transfers) on a nearly $2 million judgment against an allegedly defunct corporate debtor.
  • Represented a client unable to collect a substantial sum of money owed it. Brought action to pierce the corporate veil and set aside fraudulent transfers. Defeated defendants' key summary judgment motion and, through discovery, garnishment, and motions practice, paved the way for a mid-seven-figure settlement.
