Overview

Austin Eason counsels hospitals and other health care providers on regulatory and transactional aspects of health care law, with an emphasis on regulatory issues related to licensing, Stark Law, anti-kickback, Amendment 7/Florida Patients' Right-to-Know, Sunshine Law, and HIPAA.

Austin has significant experience analyzing liability and advising risk management departments, defending medical malpractice and facility/premises liability claims, and litigating, negotiating, and settling complex business claims, such as breach of contract, noncompetition, and nonsolicitation, as well as shareholder disputes on behalf of health care providers. Austin is a proven trial attorney, having litigated thousands of cases and taken a vast array of trials to jury verdict as lead counsel.

Austin provides assistance complying with licensing and accreditation agencies such as the Agency for Health Care Administration, the Centers for Medicare & Medicaid Services, and the Joint Commission, as well as defending licensure actions brought by the Department of Health. Austin also has experience handling a wide range of regulatory issues of concern to hospitals and providers, including Florida Consumer Collection Practices Act, Florida Deceptive and Unfair Trade Practices Act, accounts receivable management issues, billing and collections issues, and False Claims Act claims brought by the Department of Justice.

Additionally, Austin drafts and negotiates various professional services agreements, employment agreements, and clinical research agreements.
