Overview

Emily Green has more than a decade of experience in high-stakes litigation, including mass tort and product liability matters, intellectual property matters, class actions, and a variety of other complex commercial litigation. She also advises clients across industries on a broad range of regulatory compliance issues.  Emily deploys a thoughtful and realistic approach to proactively identify potential exposure and aims to provide practical advice by balancing legal risks with her client’s business needs.

Emily is deeply skilled in case management. As part of a team serving as national counsel to a Fortune 100 company for its historic asbestos litigation, she oversaw an active docket of thousands of pending cases from jurisdictions across the United States. In her capacity as national counsel, she developed national discovery and trial strategy and oversaw and directed dozens of outside law firms through all stages of litigation. Emily’s notable prior engagements include obtaining the complete dismissal of a mass tort consolidated action involving more than 100 individual plaintiffs and defeating class certification in a putative class action comprising more than 8,000 individuals alleging exposure to substances emitted from a metals plant.

During law school, Emily served as a judicial intern to the Hon. William M. Nickerson of the U.S. District Court for the District of Maryland.

Experience

  • Counsel on behalf of public utility in various bankruptcy proceedings in the District of Columbia.
  • Represented financial institution in federal appellate litigation involving the transfer of valuable real property to a revocable spousal trust and whether an individual transferor can file for bankruptcy and successfully exempt the property from creditors.
  • Assisted testimonial expert retained by the public integrity section of a state attorney general in drafting expert report for use in a pending state court action in which successor liability in contract is in dispute.
  • Counsel on behalf of the District of Columbia Public Service Commission in appellate proceeding challenging commission ruling.
  • Represented a full-service hospital in a federal court action brought by a discharged former employee. 
  • Prevailed on behalf of public utility in disallowing in its entirety a federal agency’s claim to reduce to zero the government’s obligation to pay Clean Rivers Impervious Area Charges on a 444-acre federal site in the District of Columbia.
  • Acted as a member of a team serving as national counsel to a Fortune 100 company in connection with asbestos-related personal injury lawsuits.
  • Advised telecommunications company in regulatory disputes with state attorneys general alleging failure to comply with federal and state regulations in corresponding with consumers.
  • Secured dismissals for international retailer in separate actions asserting claims for breach of contract and copyright and trademark infringement; successfully opposed motions for preliminary injunction, appeals, and petition for writ of certiorari.
  • Obtained voluntary dismissal for chemical manufacturer following successful expert challenges and favorable ruling on motion for summary judgment in consolidated action involving more than 100 individual plaintiffs alleging injuries from chemical exposure during employment.
  • Defeated class certification on behalf of chemical manufacturer following successful Daubert challenge in putative class action alleging medical monitoring claims from chemical exposure.
  • Represented pharmaceutical company as part of trial team in product liability lawsuit relating to manufacture of childhood vaccine.
  • Conducted internal investigations while representing corporate client in state and federal government investigations of alleged criminal activity.
