Frank T. Moya



Frank Moya represents and advises general contractors and volume homebuilders in construction defect disputes, payment and lien foreclosure actions, and complex commercial litigation. He also defends developers, design professionals, subcontractors, and suppliers against multimillion-dollar claims involving breach of contract, indemnity, breach of express and implied warranties, building code violations, payment disputes, delay claims, deceptive and unfair trade practices, and various negligence claims. While Frank readily defends and prosecutes construction disputes in state court, federal court, and arbitration, he has also achieved cost-effective results for his clients by counseling them toward successful mediated settlement agreements. 


  • Served as lead trial counsel to various financial institutions and private investors in multiple non-jury trials, obtaining over $15 million in final judgments. 
  • Represented national homebuilders and suppliers in defense of construction defect disputes related to alleged defects involving all building components including stucco, building envelope, waterproofing, roofing, windows, framing, and concrete.
  • Defended general contractors for commercial and residential properties, as well as insurers, in foundation subsidence and collapse claims.
  • Represented engineers, architects, and design professionals in various construction claims involving professional negligence. 
  • Represented general contractors and insurers in complex property damage claims involving losses to residential and commercial properties caused by defective building materials, as well as hurricanes, fires, floods, sinkholes, vandalism, and wind losses.
