Overview

Richard Oliver focuses his practice on representing hospitals, long-term care facilities, and individual medical practitioners in a variety of health care, administrative and commercial litigation matters at the trial and appellate levels. 

Richard also has extensive experience handling a wide range of regulatory issues of concern to hospitals and providers, including reimbursement and privacy issues.

Experience

  • Obtained summary judgment in medical malpractice case arising from alleged misdiagnosis of heart condition and claims of vicarious liability arising from alleged non-delegable duties and apparent agency.
  • Defended hospital against a series of pressure sore cases filed by a single plaintiff’s attorney, securing settlements that were a fraction of the client’s settlement target.
  • Representing several multi-unit residential property developers in property damage claims against their insurance companies and a national pest control company.
  • Defending a major international publishing company against defamation and invasion of privacy claims.
  • Representing a large financial institution against its general liability insurance carrier to recover the cost of defending against an action brought by a third party.
  • Defended national bank against fraud claims brought by borrowers.
  • Defended managed care organization providing services to a government agency against class action brought by guardian ad litem.
  • Obtained injunction in favor of managed care organization against physician group violating noncompete provisions of provider agreement.
  • Defended physician practice against fraud claims brought by patients arising from bills for medical services.
