Overview
Brian Porter is a litigator whose practice focuses in the areas of construction and business litigation. Brian represents homebuilders, general contractors, subcontractors, and manufacturers in matters involving construction defects, impact and delay claims, construction liens, bond claims, and contract disputes. He has defended his clients against multimillion-dollar claims involving breach of contract, indemnity, breach of express and implied warranties, building code violations, payment disputes, delay claims, deceptive and unfair trade practices, and various negligence claims. Brian has defended and prosecuted construction defect claims in state court, federal court, and arbitration. He effectively counsels clients toward settlements and successful mediations involving multiparty construction defect claims and contractual disputes.
Prior to joining Carlton Fields, Brian served as a law clerk to the Honorable Mary S. Scriven of the U.S. District Court for the Middle District of Florida. As a federal law clerk, Brian managed an assigned docket, drafted proposed orders in civil and criminal cases, advised the judge on legal issues, and assisted the judge in preparation for and at trials and hearings. Brian attended law school at the University of Florida Levin College of Law, where he graduated magna cum laude and earned membership in the prestigious Order of Coif.
