Overview

Jason Perkins is a commercial and construction litigator with particular experience in banking litigation, business litigation, and construction litigation. He has extensive experience representing financial institutions in lender liability litigation. He also has extensive experience representing clients in construction disputes, including acceleration claims, delay claims, defective products, mold, and water intrusion. His engagements have involved single-family homes, condominiums, convention centers, highways, hotels, tactical training centers, and sports arenas.

Jason also has significant experience in product liability law, creditor/debtor law, and complex litigation, including class action litigation and multidistrict litigation. He represents general contractors, subcontractors, suppliers, product manufacturers, homebuilders, landlords, tenants, banks, and other financial institutions.

Prior to joining the firm, Jason served as law clerk to the Honorable Anne C. Conway of the U.S. District Court for the Middle District of Florida.

  • Wells Fargo Bank, N.A. v. Campbell, No. 28-2014-CA-000343 (Fla. Cir. Ct. 2014). Represented bank in escalated foreclosure action.
  • Wells Fargo Bank, N.A. v. Ramos, No. 2012-CA-02276 (Fla. Cir. Ct. 2012). Represented bank in escalated residential foreclosure action.
  • U.S. Bank Nat'l Ass'n v. Kelly, No. 11-2009-CA-010813, 2015 WL 5459520 (Fla. Cir. Ct. Sept. 10, 2015). Represented trustee in foreclosure action.
  • JAX Utilities Mgmt., Inc. v. Hancock Bank, 164 So. 3d 1266 (Fla. 1st DCA 2015). Represented lender in lender liability litigation. In a first impression ruling, the First District Court of Appeal held that section 737.3471, Florida Statutes, bars common law remedies for equitable lien and unjust enrichment against construction lenders.

Business Litigation

  • PostNet Int'l Franchise Corp. v. R&B Cent. Enters., Inc., No. 6:08-cv-00106, 2009 WL 453413 (M.D. Fla. Feb. 23, 2009). Represented creditor in collection action.

Class Action Litigation

  • Bowen v. Joy Luck, Inc., No. 2012-33068-CICI, 2013 WL 10449068 (Fla. Cir. Ct. Nov. 21, 2013). Represented Japanese steakhouse in class action employment litigation involving Minimum Wage Amendment of the Florida Constitution at Article X, Section 24. There, the court held that the pre-suit notice requirement of section 488.110(6)(a), Florida Statutes, was not unconstitutional.
  • Addleman v. Ryland Grp., Inc., No. 11 181 01524 05 (American Arbitration Assocation). Represented homebuilder in class action arbitration regarding alleged construction defects.
  • Virgilio v. Ryland Grp., Inc., No. 6:08-cv-00815 (M.D. Fla.). Represented homebuilder in class action litigation.

Construction Litigation

  • Complete Siteworks Servs., LLC v. Guardian Ctrs. of Ga., LLC, No. 2018-V118212L (Ga. Sup. Ct. 2018). Represented owner of construction project involving improvements to tactical training and certification center.
  • Jacob Erecting & Constr., LLC v. Fed. Ins. Co., No. 162018CA002160XXXXMA (Fla. Cir. Ct. 2018). Represented construction manager in litigation involving construction of improvements to EverBank Field in Jacksonville, Florida.
  • Caldwell v. Steven Hanson; Eclipse Partners, LLC; Maverick Construction LLC; and Modus Custom Residences, No. 17-CA-000772 (Fla. Cir. Ct. 2017). Represents homeowner in construction litigation involving custom home.
  • Hunt Constr.Grp., Inc. v. A Christian Glass & Mirror Co., No. 50-2017-CA-008795 (Fla. Cir. Ct. 2017). Represents construction manager in litigation involving the ballpark of the Palm Beaches spring training facility for the Houston Astros and Washington Nationals.
  • Alberici Constructors, Inc. v. S. Fla. Stadium, LLC & Hunt Constr. Grp., Inc., No. 16-026070-CA-01 (Fla. Cir. Ct. 2016). Represents construction manager in litigation involving the Miami Dolphins stadium renovation project.
  • Tuscany Village of St. Augustine Homeowner’s Ass'n v . KB Home Jacksonville, LLC, No. 2014-CA-0808 (Fla. Cir. Ct. 2014). Represented general contractor in construction defect litigation arising out of development and construction of townhome community.
  • HRK Holdings, LLC v. Ardaman & Assocs., Inc., No. 2013-CA-000098-0 (Fla. Cir. Ct. 2013). Represented liner installer in construction defect and environmental litigation arising out of installation of liner at former Piney Point phosphate facility.
  • Designer’s Specialty Cabinet Co. v. Hunt Constr. Grp., Inc., No. 12-38823-CA-22 (Fla. Cir. Ct. 2012). Represented construction manager in litigation involving construction of Miami Marlins new baseball stadium.
  • Gulf Coast Cmty. Coll.v . McClure Design & Build Contractors, LLC and Buchanan and Harper, Inc., No. 2011-CA-1548 (Fla. Cir. Ct. 2011). Represented owner of construction project involving rehabilitation of firing range berms.
  • Phillips v. Cappo, No. 2010-CA-001688 (Fla. Cir. Ct. 2010). Represented homeowner in construction defect litigation involving custom home.
  • Boettner v. KB Home, No. 2010-30591-CICI (Fla. Cir. Ct. 2010). Represented homebuilder in construction defect litigation.
  • Harper Mech., LLC v. Hunt Constr. Grp., Inc., 23 So. 3d 772 (Fla. 5th DCA 2009). Represented construction manager in litigation involving construction of an over $500 million convention center.
  • McGuire v. Ryland Grp., Inc., 497 F. Supp. 2d 1356 (M.D. Fla. 2007). Represented homebuilder in litigation regarding alleged construction defects.
