Overview

Ben Stoll represents clients in a wide variety of complex civil and criminal litigation. In recent years, his practice has focused on intellectual property and licensing disputes, antitrust investigations, product liability lawsuits, and False Claims Act allegations. His work primarily involves the pharmaceutical, biotechnology, telecommunications, and high-tech industries.

Ben has significant experience with all aspects of litigation from pretrial investigations, through motions practice and discovery, to trials and appeals. He has represented corporations and individuals in a broad range of cases at both the trial and appellate levels and in both state and federal courts. He has litigated and advised clients on a broad range of legal issues, including contract disputes and negotiations, trade secrets, patent validity and infringement, intellectual property licensing, indemnification, shareholder disputes, False Claims Act allegations, and government investigations. He has also represented clients facing government investigations and has helped clients successfully mediate and settle disputes without resorting to formal litigation.

Ben previously served as a law clerk to the Honorable Dennis Jacobs of the U.S. Court of Appeals for the Second Circuit.

  • Defended a group of biotech companies against allegations of misappropriation of intellectual property, unfair competition, and tortious interference related to the development of a new pharmaceutical product.
  • Represented a major technology company in connection with a highly publicized FTC investigation and subsequent DOJ antitrust lawsuit over online search and search advertising.
  • Defended a national telecommunications company in federal court and on appeal to the Ninth Circuit against allegations of violating the False Claims Act.
  • Represented a pharmaceutical company in a two-week jury trial involving a contract dispute over the licensing of one of its key medical products.
  • Defended a major HVAC company against a multihundred-million-dollar wrongful death and personal injury lawsuit over an explosion at a hospital construction project.
  • Mediated and settled a patent and trade secret licensing dispute on behalf of a major pharmaceutical company against an academic institution.
  • Defended a journalist in a criminal bench trial against allegations that she trespassed and engaged in rioting while covering a major national news story.
  • Represented a safety equipment company against product defect claims brought by the families of deceased and injured firefighters.
  • Settled a shareholder dispute on behalf of the majority owner of a forestry company seeking to buy out the minority investors.
  • Represented an injured protester in a Section 1983 excessive force lawsuit against a local government and its police department.
  • Helped an international pharmaceutical company evaluate its licenses and patent rights in anticipation of the launch of a new pharmaceutical product.
