Two Must-Watch States on Privacy Litigation

Carlton Fields’ Cybersecurity and Privacy Practice Chair Joseph W. Swanson was quoted in an article about two states, Illinois and California, whose courts and legislatures are raising interesting questions in privacy law. The article in CyberInsecurity News also cited the Carlton Fields 2019 Class Action Survey, which found that 66% of companies reported concern about their future class action exposure as a result of the California Consumer Privacy Act, set to go into effect on Jan. 1, 2020.
 
Swanson suggested that businesses ask themselves numerous questions to prepare for the implementation of the law, including what data the company collects, how it collects the data, whether it shares the data with third parties, and what kind of consent it obtains when it collects the data.
