Carlton Fields attorneys Aaron Weiss and Michael Zilber authored a Law360 article about the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) and its forum selection clause.

This article is the third in a series on the topic of FDUTPA, the first of which was written on the act’s unusual unfairness prong, and the second of which was written about FDUTPA’s split on standing.

The column comments on the split between Florida appellate and federal district courts on when a forum selection clause applies to a claim under FDUTPA, and the various decisions where courts have reached differing results.
