Simon Gaugush Authors Law360 Article on FBI’s Investigation into Michael Flynn

Carlton Fields white collar crime and government investigations attorney Simon Gaugush authored a Law360 article, “Flynn’s False Statement Charge Reveals Failed Investigation,” on the federal investigation into Michael Flynn.

The FBI initially investigated Michael Flynn’s activities as they related to Russia’s interference efforts in the 2016 election. When federal investigators weren’t able to find any wrongdoing, they applied a Section 1001 charge, opined as one of the most misused federal investigation tools.

Gaugush analyzes why the 1001 charge tends to appear in certain investigations that aren’t going anywhere, and argues that the charge is ultimately an occurrence of a failed federal investigation.
