LG Exploding Battery Suits Find Likely Path Forward in Ga.

Carlton Fields Shareholder Robert “Bobby” Shannon was featured in a Law360 article, “LG Exploding Battery Suits Find Likely Path Forward in Ga.,” regarding the Supreme Court’s recent ruling that major international manufacturers can be sued in states where “they do a substantial amount of business,” potentially leading to LG’s lithium-ion battery suits having standing in state court.

Shannon told Law360 that the courts struggle with how to handle these types of issues, since consumers can now purchase products off the internet and ship them directly to their door.

He added that while state courts generally have a lower jurisdictional bar than federal courts, and state judges are also more likely to be liberal when deciding if a foreign defendant is subject to jurisdiction for allegedly harming members of the communities that elect them to the bench, “it can be very difficult to prove a foreign manufacturer is directly responsible for its products being sold in America by unauthorized third parties for unintended uses.”
