Aaron Weiss was quoted in a Law360 article titled “Full 11th Circ. Says 1 Text Message Justifies TCPA Standing.” The article discusses a recent Eleventh Circuit decision holding that a plaintiff who receives a single, unwarranted, illegal text message has standing to sue under the Telephone Consumer Protection Act, departing from the court's precedent setting a relatively high bar for standing in TCPA class actions.

"This decision will at least mostly harmonize the issue in federal court," Weiss said. "The new fight in Florida will be over state or federal court, as the only state appellate decision — which is binding on every state trial court in Florida — holds there is no standing in these types of cases."
