Three major wireless carriers had asked the U.S. Supreme Court justices to jettison the FCC's long-held power to impose fines by using an in-house administrative trial that did not afford parties a federal court hearing at the outset, arguing it violates their Seventh Amendment rights. In June, the court ruled in favor of the commission, finding that the wireless carriers cannot use the constitutional right to a jury trial to avoid nearly $200 million in fines imposed by the FCC.
Weiss stated that after the ruling, the attention has shifted from the FCC's authority to the process it uses to impose fines. Depending on who's leading the agency, the commission might choose to pursue fines in district court anyway. "It may be that the more direct way to do it now will be through the district courts, and maybe that is where we'll start to see more of the action starting with, as opposed to this in-house kind of process," he said.
