Bill Sklar Interviewed in Law360: “Fla. Shares Insights on Condo Inspections, but With Big Gaps”

Bill Sklar was interviewed in Law360 Real Estate Authority, in an article titled “Fla. Shares Insights on Condo Inspections, but With Big Gaps.” The article discusses a recent report from the Office of Program Policy Analysis and Government Accountability — a research arm of the Florida Legislature — that examined the results of new regulations following the deadly 2021 collapse of the Champlain Towers South in Surfside, Florida. Attorneys and other observers claim that the report highlights a significant gap in local government reporting.

Asked whether the shortcomings identified in the report are likely to become a topic of discussion and possibly more legislation in the 2027 session, Sklar said, "Absolutely. It should be."

"We've discussed four bills over the last five years to create inspections, maintenance standards, safety requirements — and half of the associations, presumably, have just said either, 'No,' or 'Catch me if you can,' or 'We're not going to do anything until someone asks for it.' And that's insufficient. ... There's a reason this was done," he added.

Sklar also commented on the impacts the new program has had on the market. "The bottom line is there's two markets," he said. "[The] new condo and recent condo market [is] going strong — [it has] somewhat cooled off as far as price increases, but it's still going strong. Older condominiums, they're under a stigma, and unless they have performed these inspections and set up the reserves and established they have done some of the work, they are stigmatized, and their pricing is depressed."
