Bill Sklar Quoted in Law360: “What's Next After Fla. Courts Block Condo Termination Bid”
Bill Sklar was quoted in a Law360 article titled “What's Next After Fla. Courts Block Condo Termination Bid.” The article discusses the Florida Supreme Court’s decision not to take up a developer's appeal of a ruling blocking its bid to redevelop a Miami condominium tower. The decision has amplified debate over laws governing condo terminations and whether state legislators should take action.
Commenting on the need to update Florida’s governing statutes, Sklar said some people think the current law has incentivized a small minority block terminations can enable “extortive” tactics and said lawmakers should modernize the statutes to reflect today’s economic and safety realities. He noted that perceptions of bulk buyers have shifted since the Surfside collapse, with many now viewing them as partners in addressing aging buildings rather than profiteers. "Now bulk buyers are viewed with white hats, as someone who comes in not to take advantage, not to underpay, not to dispossess people, but as an alternative to high reserves, high remediation and substantial special assessments," he said. "So, the role of the bulk buyer is now the opposite of what it was perceived as when these laws were passed."
