David Karp Interviewed in Law360: “5 Supreme Court Cases to Watch This Spring”

David Karp was interviewed in Law360, in an article titled “5 Supreme Court Cases to Watch This Spring.” The article discusses the U.S. Supreme Court's current term as the justices prepare for a spring docket packed with questions over the level of deference courts should give federal agencies, whether and how social media companies should be regulated, and whether government efforts to combat misinformation crosses the line between persuasion and coercion.

"It's going to be a blockbuster term," Karp said.

Discussing content moderation policies and First Amendment rights, Karp said the court's decision in these cases will cause a "sea change in the law" surrounding social media platforms, as the justices will decide for the first time whether social media platforms are entitled to established First Amendment rights or if another set of rules applies to them.

Karp expects the justices to issue fact- and case-specific rulings that could influence how other courts treat state action-related cases in the future. "Oftentimes, how the court applies the standard to a given set of facts can be highly influential on how courts decide other cases," he said.
