Mitra commented on Kadrey v. Meta Platforms Inc., which saw a ruling in favor of Meta Platforms Inc. regarding the fairness of using copyrighted material for AI training. "I think we are going to see a lot of divergence in the way courts analyze these issues, and in a few years, I'm sure we'll be up in the Supreme Court," Mitra said.
Mitra said the different approaches the judges took in reaching their conclusions underline the likelihood that court opinions in the dozens of pending AI copyright cases "are going to vary a great deal" and that it remains unclear what is permissible when it comes to using copyrighted material to train AI systems. "Does this open the door for you to acquire data for use that you can argue is noncompeting in other contexts and therefore justified? And if it is noncompeting, why did you acquire the data in the first place?" she said. "I think there are lots of complexities and nuances that still have to be ironed out."
