Markham Leventhal Quoted in Law360: Texas Farm Bureau Insurance Companies Beat OT Claims in Jury Trial

Markham Leventhal was quoted in Law360, in an article discussing a recent Carlton Fields victory and complete defense verdict for Southern Farm Bureau Life Insurance Company.

The seven-year suit involved a dozen terminated insurance agency managers who had signed contracts agreeing to manage their agencies as independent contractors.  After their contracts terminated, the agency managers claimed they were “employees” under the Fair Labor Standards Act and should be paid overtime for weeks they allegedly worked over 40 hours.  Following a two-week trial, the jury found that the agency managers failed to prove they were entitled to overtime pay, resulting in the third consecutive jury verdict in favor of the Texas Farm Bureau insurance companies and Carlton Fields client Southern Farm Bureau Life.

Leventhal told Law360 that the defendants were "greatly appreciative that the jury came to the correct decision in rejecting each and every one of the plaintiffs' claims."
