Scott Abeles was quoted in Law360 in an article titled “Supreme Court Eyes Its 'Next Frontier' in FCC Delegation Case.” The article discusses a case about broadband subsidies that could give the U.S. Supreme Court a chance to bring back an important separation of powers principle.

In the article, Abeles states that a decision reviving the nondelegation doctrine may require an overhaul of the entire federal government system. Any current regulations could also be deemed invalid if the agency promulgating them was found to have an unlawful delegation of legislative power.
