Carlton Fields Post-Judgment Enforcement Team Obtains $1.5M Settlement in Complex Asset Protection Scheme

Carlton Fields’ post-judgment enforcement team obtained a hard-won $1.5 million settlement from a debtor in a complex asset protection scheme that included assets held in tenancy by the entirety with the debtor’s wife.

Our team fought discovery battles for months, uncovering tidbits of financial information that led to the discovery of new assets. Further complicating matters, pending at the time of settlement were five contempt hearings, three contested garnishment actions, a $1.5 million-plus fraudulent transfer action, a complex foreclosure action on real property, and a contested assignment for the benefit of creditors action. Our team leveraged the actions above into the $1.5 million settlement.
