Carlton Fields Successfully Represents Cape Canaveral Marine Center in Milestone Litigation
WEST PALM BEACH, FL – Carlton Fields successfully represented Cape Canaveral Marine Center, LP (CCMC) in long-running litigation related to marina property operations and leasehold interests at Port Canaveral.
The matter stems from a series of transactions and redevelopment efforts dating back more than two decades, during which portions of the property were developed to support expanded marina facilities and marine service operations. Following CCMC’s acquisition of the leasehold interests in 2017, disputes arose concerning operational rights, property use, and contractual responsibilities between the parties, resulting in five circuit court cases, three trials and at least three appeals.
In a recent final judgment, the Circuit Court for Brevard County ruled in favor of CCMC, concluding that key contractual obligations necessary to complete a proposed transaction were not satisfied. The court denied claims seeking to compel the sale and determined that CCMC was the prevailing party. The ruling provides clarity regarding the parties’ contractual rights and supports continued stability in marina operations at the Port Canaveral property.
