Aaron Weiss was quoted in a Capitol Forum article titled, “FCC Policy: Eleventh Circuit Judge Critical of FCC Rulemaking in One-to-One Consent Rule; Panel Action Increasingly Possible Before Rule’s Effective Date.” The article discusses the uncertain outcome of the Federal Communications Commission’s one-to-one consent rule after oral argument before the Eleventh Circuit Court of Appeals. The rule is set to go into effect on January 27, 2025.
“Without necessarily putting a percentage, I would say I think an ultimate vacatur is more likely than I would have thought before the oral arguments,” said Weiss, but cautioned that companies should still align their consent practices given the high stakes of TCPA compliance.
