Overview

Eden Franco is an intellectual property attorney with a particular focus on intellectual property licensing, technology transactions, trademarks, cybersecurity, and data privacy. Eden provides intellectual property advice to clients in Florida and throughout the United States. 

Eden drafts and negotiates agreements on a wide range of intellectual property and information technology matters, including software license agreements, software-as-a-service (SaaS) agreements, end-user license agreements, traditional master service agreements, reseller agreements, data protection addenda, and other related agreements across a wide range of industries, including for Fortune 500 companies. 

Eden also conducts comprehensive trademark and design searches and analyzes federal, state, and common law sources to evaluate potential obstacles to registration. In conjunction with such trademark and design searches, Eden provides strategic legal analysis to guide clients in assessing registrability, enforcement risk, and brand adoption decisions. Eden also advises clients on trademark enforcement and brand protection. She regularly drafts cease-and-desist letters and prepares takedown notices to address infringing, misleading, or unauthorized uses of client trademarks. Eden works to quickly stop unauthorized uses of client trademarks, helping clients maintain brand control and deter future infringement.

Eden  also guides organizations in various industries through data breaches and other cybersecurity incidents, including drafting incident response plans and breach notifications, and responding to regulatory inquiries.

Eden has a background in corporate compliance and mergers and acquisitions, particularly in the health care industry. Her combined knowledge and passion for compliance and IT makes her an asset to the clients she serves. 

Prior to joining Carlton Fields, Eden served as a law clerk to the Honorable Martin A. Fitzpatrick of the U.S. District Court for the Northern District of Florida.

Outside the office, Eden is a botany enthusiast, has a strong interest in interior and exterior design, and enjoys exploring new destinations through travel. Eden is also fluent in Hebrew.
