Overview
Morgan Klein is a licensed patent attorney whose practice includes patent, trademark, and copyright litigation, prosecution, portfolio management, and transactional matters. Morgan has extensive experience representing pharmaceutical companies in Hatch-Waxman litigation and providing strategic counseling on pre-litigation planning, risk assessment, and enforcement strategies.
As a registered patent practitioner before the U.S. Patent and Trademark Office, Morgan works closely with clients to develop tailored strategies for protecting innovations and maximizing the value of intellectual property portfolios. She has experience with trademark litigation, assisting clients with brand protection. In addition to prosecution and litigation work, Morgan’s experience extends to corporate transactions with drafting and negotiating intellectual property agreements, ensuring that clients’ intellectual property assets are safeguarded.
Morgan has further worked on numerous mergers and acquisitions with responsibilities focused on intellectual property assets, including drafting purchase and sale agreements, master services agreements, professional services and assignment agreements, in addition to conducting IP due diligence. Morgan has further drafted assignment agreements and non-disclosure agreements for employees and contractors in varying areas of specialty. Morgan frequently advises clients on preexisting agreements, particularly where those contracts implicate IP ownership, licensing, or commercialization in anticipation of contract negotiations.

- Counsel for MIA Shoes, QVC, Famous Footwear, DSW, and Stitch Fix in Rothy's Inc. v. MIA Shoes Inc., a patent and trade dress litigation in the District of Delaware concerning footwear.
- Counsel for Foundation Partners Group in After Services Inc. v. Foundation Partners Group LLC, a trademark infringement action in the District of Nevada.
