2025 Class Action Survey, Markham Leventhal Featured in Life Annuity Specialist: “Insurers Under Fire: Class Actions Push Legal Costs to New Highs”

Markham Leventhal was interviewed in a Life Annuity Specialist article titled “Insurers Under Fire: Class Actions Push Legal Costs to New Highs.” The article discusses the Carlton Fields 2025 Class Action Survey, which found that a growing proportion of class action litigation is hitting insurers.

In addition to class action cases becoming more time-consuming and more difficult to resolve, Leventhal noted that rising legal costs have spurred insurers to use fewer but more specialized defense firms for class action lawsuits, and to allocate more in-house resources to class action cases. He gave an example, stating that a legal department may redirect existing staff or create new positions to focus solely on these types of lawsuits. "Internal specialization is more effective and efficient for a company," he said. "We're seeing more of that."
