2026 Class Action Survey Featured in Washington Post: “Would You Like a Lawsuit With That?”

The 2026 Carlton Fields Class Action Survey was featured in a Washington Post editorial titled “Would You Like a Lawsuit With That?” The editorial discusses a class action lawsuit filed last year alleging that McDonald’s misleads customers by not using more-expensive rib meat in their McRib sandwich.

The piece claims that defending against the class actions saps corporate resources that could be better deployed for investment, hiring, or keeping prices lower for customers. This year’s survey found that U.S. companies with more than $1 billion in revenue spent a total of $4.53 billion defending against class action lawsuits, more than double the level in 2011. Spending this year is expected to rise to $4.8 billion, the 11th consecutive record year.
