Overview

Jon Ginsberg has more than a decade of experience handling complex litigation, with a primary focus on business and commercial disputes and First Amendment litigation. He has extensive experience navigating every stage of litigation, from trial to appeal, in both state and federal courts.

Jon’s First Amendment practice includes significant experience representing news publishers and media organizations in federal courts across the country, often in cases involving access to government and judicial records. He also advises clients in connection with section 230 of the Communications Decency Act and other content-related issues.

In his commercial litigation practice, Jon advises a diverse range of clients — including hotel owners and operators, financial institutions, real estate developers, national retailers, and startups — on matters involving contract disputes, real estate issues, and other business-related claims. His work has also included cases involving employment discrimination, mass torts, insurance fraud, and product liability.

Jon works closely with clients to understand their goals, offering tailored strategies for their industry and challenges and exploring alternatives to litigation to deliver the best possible results.

Committed to pro bono work, Jon has successfully represented asylum seekers, including obtaining asylum for two Syrian refugees and one Honduran refugee.
 

Experience

  • Successfully represented nationwide and local media companies in First Amendment challenges to delays in access to court records.
  • Obtained dismissals and appellate victories for major provider of online marketplace for automobile sales against statutory consumer fraud claims, in actions involving section 230 of the Communications Decency Act.
  • Successfully represented and achieved summary judgment on behalf of the sponsor of a residence club and one of the world’s largest hotel companies in a multimillion-dollar litigation arising out of express and implied contract claims brought by more than 100 owners of fractional interests.
  • Achieved full defense verdict for major rental truck company arising out of product liability claims at arbitration.
  • Successfully represented major financial services company in putative class action challenging expired gift card fees through appeal.
  • Successfully represented a global technology consulting company in several litigations involving claims ranging from employment discrimination to breach of contract.
  • Obtained dismissal for major financial institution of claims seeking to recover more than $12 million for alleged violations of the Fair Credit Reporting Act.
  • Represented major paper distributor in multijurisdiction litigation, resulting in partial dismissal and favorable resolution of claims seeking payment of $3.5 million junior debt.
  • Represented music production company against deceptive business practices claims arising out of canceled performances as the result of the COVID-19 pandemic.
  • Represented public benefit corporations in federal Superfund litigation, resulting in the favorable resolution of claims seeking to recover approximately $20 million under the Comprehensive Environmental Response, Compensation, and Liability Act.
  • Successfully litigated several declaratory judgment actions on behalf of major rental company establishing no insurance coverage as the result of fraudulent conduct.
  • Successfully represented condominium owners and members of the governing property owners association in dispute related to conveyance of public access easement.
  • Obtained summary judgment in decadelong federal litigation against major financial institution alleging claims of hostile work environment, sexual harassment, and retaliation.
  • Represented an international provider of office accommodations in complex commercial landlord-tenant disputes, as well as actions involving allegations of breach of contract, defamation, tortious interference, and statutory consumer fraud claims.
  • Represented banking clients in numerous actions related to consumer financial transactions in both state and federal courts, including the favorable resolution of allegations concerning breach of contract, fraud, and a variety of claims under state and federal statutes, such as TILA, RESPA, FDCPA, and FCRA.
