Overview
Tom Rohback is a trial lawyer with more than 40 years of experience handling complex, high-stakes disputes nationwide. He has tried over 30 jury and bench trials and has led appeals and class actions in federal and state courts across the country.
Tom is frequently brought into matters at critical stages, including after adverse rulings or when cases become particularly challenging. For a major insurer, he was asked to try an unfair trade practices class action seeking more than $400 million after class certification had been granted and discovery sanctions imposed; the case proceeded to trial and ultimately resulted in a defense verdict. He also tried three federal employment discrimination jury cases in a three-month period for an electric utility, obtaining a directed verdict in each.
He has successfully tried multimillion-dollar claims on behalf of a bankruptcy trustee against corporate officers and directors in New York, and secured a jury verdict in a high-profile fraud case in West Virginia involving the murder of an insured. In Massachusetts, he helped win dismissal of a $100 million putative securities class action involving a Spanish telecommunications company. In a multidistrict antitrust matter in Florida, he served on the defendants’ steering committee and helped obtain dismissal of all complaints before discovery.

- Won a federal jury verdict in Indiana for a major manufacturer, defeating breach of contract claims and securing damages on a fraud counterclaim, affirmed on appeal.
- Secured summary judgment in bankruptcy court for an Am Law 100 firm in a multimillion-dollar malpractice action brought by 50 Cent, and prevailed at trial on the firm’s claim for unpaid legal fees; affirmed on appeal.
- Defeated class certification in California consumer protection actions seeking $160 million, with the court finding each named plaintiff inadequate.
- Led settlement negotiations in four putative class actions involving approximately 40 million class members against telecommunications and insurance providers.
- Successfully opposed class certification in New Mexico based on lack of numerosity before expert discovery.
- Won dismissal of claims under New Mexico insurance law seeking injunctive relief in a multi-defendant class action.
- Defeated an attempt by the state of Connecticut to obtain injunctive relief in a multimillion-dollar antitrust matter; emergency appeals were dismissed.
- Defended an insurance company in multiple wage-and-hour class and collective actions under the Fair Labor Standards Act.
- Represented a major European aircraft manufacturer in a confidential international arbitration involving a long-term supply agreement, securing a favorable award after hearings in New York.
- Won a confidential arbitration involving breach of fiduciary duty claims arising from a natural gas exploration project off Gaza.
