The 2023 Carlton Fields Class Action Survey provides an overview of important issues and practices related to class action matters and management. The annual publication reports on historical trends captured since the survey’s inception 12 years ago and includes information related to emerging issues in class action litigation.

The results of this year's survey of in-house attorneys at some of the largest companies in the U.S. indicate that companies expect more labor and employment and consumer fraud class claims. The survey also highlights the continued growth in legal expenses and describes in-house counsel’s efforts to manage those expenses while not compromising on a defense.

In this webinar, our presenters:

  • Identify and discuss best practices in reducing cost and managing risk in class action litigation.
  • Review the type and frequency of class actions reported in the survey.
  • Summarize key recent developments in the law and identify the most successful defenses to class certification as reported by corporate counsel at more than 400 companies.

The webinar is especially useful for in-house counsel and executives with responsibility for class action litigation and risk management, and relevant for companies across a spectrum of industries. This year’s webinar includes a particular focus on labor and employment litigation, which the survey showed comprises about one-third of the average class action docket at large U.S. companies.
